Online divorce in the UAE: a laptop, phone and leather folder on a walnut desk by a window overlooking Dubai at night

What “Online Divorce” Means in the UAE

In the UAE, “online divorce” means an ordinary court divorce handled through the court’s digital channels, not a separate, faster kind of divorce. Federal Decree-Law No. 42 of 2022, the Civil Procedure Code, lets a case be filed electronically, served by text message or email, heard by video and decided in an electronic judgment. Each court runs its own portal, and each still sets limits.

3 business days to pay the fee after the payment notice
10 business days for the other spouse to file a defence
AED 100 per Dubai personal status application, capped at AED 2,000
AED 5,000 Abu Dhabi civil divorce application

How this site earns money

DivorceU.AE is a referral service, not a law firm. It earns when readers ask to be put in touch with a UAE-licensed family lawyer. Everything below can be done without one; the page says where help tends to pay for itself.

What the Civil Procedure Code Allows You to Do Online

The Civil Procedure Code allows almost every stage of a case to happen electronically: Article 330 says fee collection, registration, service, documents, attendance, pleading, witnesses, judgments, appeals and execution are all valid if done wholly or partly remotely. The code applies in every emirate, so these rules hold whichever court hears your divorce.

StageWhat the law saysArticle
Filing the claimA case starts with a statement of claim filed with the Case Management Office in electronic or paper format, under the court’s own procedures.44(1)
Paying the feeThe case is registered once fees are collected. Pay within 3 business days from the day after the payment notice, or the registration is void.47(1)
Service on your spouseBy recorded audio or video call, text message, smart applications, email, fax or other modern means; also by hand at home, work or an elected domicile; failing that, by posting on the court’s website.9(1)(a)
When service countsFrom the date the email, text, fax or recorded message is sent; for a website posting, from the date of posting.11
The defenceFiled electronically or on paper within 10 business days of service. Where the file is electronic, the court lets the parties review the claim on its system or sends it to them.48(2), 49
HearingsThe court president, circuit president or judge may take any procedure remotely, at any stage.331
Asking for an in-person hearingIn a remote trial, any party may ask at each hearing for the trial to be held in person. The court decides after notifying the other parties.333
RecordsRemote hearings are recorded, kept electronically and confidential.334
The judgmentAn enforceable copy obtained remotely carries the writ of execution and an electronic signature. Certified copies can be delivered electronically or on paper.131(1), 131(3)
E-signaturesElectronic signatures and documents have the same authenticity as official paper ones if they meet the Electronic Transactions and Trust Services law.338

Federal Decree-Law No. 42 of 2022, official English translation. The Arabic text prevails.

Two of these rules are easy to miss. The three-day fee window is short, and a missed payment voids the filing, so pay the same day the notice arrives. And because electronic service counts from the moment of sending, a text from the court that you overlook does not stop the clock on your 10-day defence period. A court notice sent through a messaging app is also a different thing from a spouse’s message announcing a divorce; for that, see whether a WhatsApp divorce is valid in the UAE.

Article 328 defines remote communication technology as audiovisual communication for remote attendance and the exchange of documents, covering registration, service, trial and execution. A remote hearing is a tool the judge may use, not a right. What you can do is ask for the opposite: if you would rather be in the room, for example with an interpreter beside you, Article 333 lets you ask at each hearing.

Court by Court: Where Your Divorce Is Handled Online

Which portal you use depends on which court hears the case. Abu Dhabi, Dubai and Ras Al Khaimah keep their own judicial departments. Sharjah joined them: an Emiri decree of October 2024 created the Sharjah Judicial Department, Sharjah Law No. 7 of 2025 now regulates its judiciary, and its Court of Cassation first sat in July 2025 (some government pages still list Sharjah as federal). Ajman, Fujairah and Umm Al Quwain follow the federal judicial system run under the Ministry of Justice. Here is what each one offers for family cases, based on the courts’ own service pages.

Dubai Courts

Dubai Courts takes family cases online through its website and through the government service centres known as Al Adheed, and it also runs a smart app. You need a registered account; individuals sign in with UAE PASS. Two services matter for a divorce.

Family Conciliation

The Family Guidance file. Open to a citizen or resident of Dubai, or someone working there. You upload your marriage contract as a PDF. There is no fee. The journey is: register the file, attend the sessions, receive a decision, which can be a settlement agreement, a waiver, closure of the file or a referral to the competent court.

Personal Status Claims

The divorce claim itself. You upload the statement of claim and a docket of supporting documents, plus the referral from the Family Conciliation section. One party must be a citizen or resident of Dubai. Fee: AED 100 per application, capped at AED 2,000. The result is an electronic first-instance judgment.

The claims page still lists the Family Conciliation referral among the uploads. Non-Muslim civil divorces are not referred to Family Guidance (Article 3 of the 2022 law), so in a civil case, check with the court or a typing office what the system asks for at that step. One step is not online at all. Dubai Courts’ service for certifying uncontested personal status declarations (ishhadat) requires you, or an agent holding a special official power of attorney, to appear with your original ID before a judge or certifier, with two witnesses, for a fee of AED 220. The full Dubai sequence, including timelines, is in our guide on how to file for divorce in Dubai.

Abu Dhabi Judicial Department

Abu Dhabi handles the two tracks differently, and neither is online from start to finish.

The court’s page lists Abu Dhabi residents and couples who married at that court as eligible, says the parties must come from a country not governed by sharia law, and warns that Arab League nationals may be asked for an official document proving their religion. Proceedings there run in English. Step-by-step detail is in how to file for divorce in Abu Dhabi.

Sharjah Courts

Sharjah now runs its own courts under the Sharjah Judicial Department. In January 2026 it launched the Sharjah Judiciary Platform (sjd.ae) for unified court services, including personal status cases. Because the move is recent, check the platform or call the court before you rely on an older guide.

Federal courts: Ajman, Fujairah and Umm Al Quwain

Family cases in these three emirates go to the federal courts. The Ministry of Justice runs an e-Filing System for them and lists a family consultations service on its website. In November 2025 the federal judiciary issued five regulations under the 2024 Personal Status Law, including Decision No. 67 of 2025 on Family Guidance, with the stated aim of expanding digital services. The ministry’s English pages give little procedural detail, so confirm the current steps with the court where you file.

Ras Al Khaimah Courts

Ras Al Khaimah has its own local courts. Its family services sit on the Ras Al Khaimah government e-services portal, which the UAE Government portal links to for family cases. We could not load an official page describing the current online steps, so confirm them with RAK Courts directly.

DIFC and ADGM are not an online shortcut

The DIFC Courts and ADGM Courts often come up in searches for digital courts, but they have no family jurisdiction and cannot grant a divorce. Their portals play no part in a UAE divorce.

Family Guidance Online: Who Goes and Can You Attend by Video?

Family Guidance belongs to the 2024 Personal Status Law track used by Muslim couples, and even there it is not automatic. Under Article 8 of Federal Decree-Law No. 41 of 2024, the supervising judge may refer the spouses to Family Guidance before the case goes to court, if he or she thinks a settlement is feasible. There is no fixed guidance period in the law.

Some cases skip it altogether: wills, inheritance, urgent and temporary cases, urgent or temporary orders on alimony, custody and tutorship, and cases where reconciliation is not foreseeable, such as cases to prove a marriage or to prove a divorce. If you settle, the agreement is written into a report signed by both spouses and the counsellor and approved by the supervising judge. It then has the force of an execution writ and cannot be appealed unless it contradicts the law.

Whether the sessions themselves can be remote depends on the court:

Non-Muslims skip this stage completely. Article 3 of Federal Decree-Law No. 41 of 2022 says divorce cases under that law are not referred to Family Guidance and go straight to court for a judgment at the first hearing. Either spouse can apply on the prescribed form without proving harm, and the divorce takes place by court decision once the other spouse has been duly served (Article 8). In practice, that makes the civil track the one where “online divorce” is most real: one electronic filing, electronic service, one hearing, an electronic judgment.

Filing for Divorce in the UAE From Abroad

You can usually start and run a UAE divorce from outside the country, provided a UAE court has jurisdiction and you appoint someone locally. Three things decide whether it works.

1. Which court can hear it

For Muslim couples, Article 3 of the 2024 law lets UAE courts hear cases against citizens and foreigners who have a domicile, residence or place of work in the State. A wife’s divorce case can be filed where either spouse lives or works, or where the marital home is. If the respondent has no base in the UAE, the case goes to the plaintiff’s court, otherwise to the court of the capital (Article 3(6)). Article 4 also lets a wife resident in the UAE sue a husband who had a base here but abandoned her and moved abroad, was deported, or whose address abroad is unknown.

2. An elected domicile and a representative

A plaintiff with no domicile in the UAE must name an elected domicile and a legal representative in the claim (Article 44(2)(a) of the Civil Procedure Code). Under Article 52, you can appear through a lawyer, or through a relative or in-law up to the fourth degree.

3. A power of attorney that the court will accept

A power of attorney signed abroad is not ready to use until it has been through the legalisation chain. Dubai Courts’ service pages spell it out: a document issued outside the UAE must be certified by the foreign ministry of the issuing country, then the UAE embassy there, then the UAE Ministry of Foreign Affairs, and translated into Arabic by a legal translator approved by the Ministry of Justice. The UAE is not a party to the Hague Apostille Convention, so an apostille on its own does not replace these steps.

Once the case is running, the court can take remote steps outside the emirate’s territory, coordinating with the authority where the person or documents are (Article 332), and can use remote technology for judicial assistance with foreign countries under ratified treaties (Article 337). That makes a video appearance from abroad possible, but it remains the judge’s decision (Article 331), so ask before the hearing date rather than on the morning.

The rules above are from the 2024 Muslim personal status law. The 2022 civil law has its own scope: Article 1 covers non-Muslim UAE nationals and non-Muslim foreigners residing in the State. If you are a non-Muslim couple and neither of you lives in the UAE any more, take advice on jurisdiction before you pay any fee.

Documents to Scan, and How Translation Works

For an online filing in Dubai, every document goes in as a PDF translated into Arabic, while the Abu Dhabi Civil Family Court works in English. Dubai Courts’ service pages require soft copies in PDF format, translated by a legal translator approved by the Ministry of Justice, with foreign documents legalised abroad and attested in the UAE first. Expect the same Arabic requirement at the federal courts and in Ras Al Khaimah.

Scan in colour, one PDF per document, with the translation attached behind the original. Name each file plainly (“marriage-certificate-attested.pdf”). A blurred attestation stamp can lead to a request to re-upload, which costs time. The complete checklist, including what each emirate asks for, is in documents required for divorce in the UAE.

How to Track Your Case and Get the Judgment

You track a UAE divorce case through the court’s own account system or app, using your case number. There is no national search across all courts.

Dubai

Logged in, your files appear in your account. The public site also lists inquiry services for case details, “smart” verdicts, case applications and ishhadat certificates, which work from a case, application or certificate reference number.

Abu Dhabi

The AD Judicial app shows your file, its status in the courts, scheduled dates and notifications, and lets you submit requests on the file. The court also sends SMS notices to the number you gave when filing.

Federal courts and RAK

Use the Ministry of Justice e-Filing System or the Ras Al Khaimah e-services portal, depending on where you filed, and keep the case number from your first receipt.

A note on searching by Emirates ID: we could not find an official Dubai Courts public search that works from an Emirates ID number alone. The Emirates ID checks you may read about online are usually Dubai Police services for financial criminal cases and travel bans, not family court files.

Getting the judgment and certificate

The output of a Dubai personal status claim is an electronic first-instance judgment, and the Civil Procedure Code lets certified copies be delivered electronically (Article 131(3)), with the writ of execution and an electronic signature on an enforceable copy obtained remotely (Article 131(1)). Under Article 9 of the 2024 law, the appeal period in personal status matters is 30 days, counted from the day after the judgment if it was issued in your presence, otherwise from the day after you were notified (Article 10). Where a divorce was recorded as a declaration in Dubai rather than decided in a claim, the result is an ishhad document instead of a judgment.

For use abroad, an electronic copy is rarely the end of it. Foreign registries and courts commonly want an attested copy with a translation. See UAE divorce certificate attestation before you book any appointment back home.

Step by Step: What Is Online and What Is Not

Most of the court process is online; the steps that are not are the ones that prove who you are or record a declaration.

“Online Divorce” Websites: What They Cannot Do

No website, app or agent can divorce you in the UAE. A UAE divorce is created or recorded by a court: a judgment, a Family Guidance settlement approved by the supervising judge, or a talaq documented before the competent court. Anything else is, at best, a form-filling service.

Typing centres and legal translators do real work, and the Abu Dhabi Civil Family Court requires the first. The trouble starts when a site sells something the law does not offer. Be wary of:

A talaq still has to be documented

For Muslim couples, a talaq pronounced by the husband does not end the paperwork. Article 58 of the 2024 Personal Status Law requires the husband to document the divorce before the competent court within 15 days of it happening, and this does not affect the wife’s right to bring a case to prove the divorce. If he misses the deadline without an excuse the court accepts, the wife is entitled to compensation equal to alimony from the date of the divorce to the date it is documented. Documentation is a legal duty with a financial penalty, and in Dubai the court’s documentation service is described as an in-person step (you or an agent with a special power of attorney), so do not plan on finishing it from a screen without checking the current channel first.

Does Your Nationality Change the Online Process?

No. A Filipino, Indian, British or Emirati filer uses the same portal, uploads the same kind of PDFs and pays the same fees. Nationality affects which law applies and what happens to the judgment back home.

For non-Muslim foreigners, Article 1 of Federal Decree-Law No. 41 of 2022 applies the civil law unless one spouse insists on the law of their home country. If that law limits divorce, the insistence changes the whole case, so settle the choice of law before you file. Recognition is the second question: a UAE judgment does not register itself abroad. See our guide to Filipino divorce in the UAE for what happens in the Philippines.

Frequently Asked Questions

Can I get divorced in Dubai without going to court?

You can avoid the courthouse building for most steps, but not the court. Every valid UAE divorce comes from a judgment, a settlement approved by the supervising judge, or a talaq documented before the competent court. In Dubai the claim, the fee, the uploads and the notices can all be handled online, and hearings can be held by video if the court allows it. Documenting a talaq may be different: Dubai Courts’ documentation and certification service asks you, or an agent with a special power of attorney, to attend with your original ID, so check the current channel before you rely on doing it remotely.

Can I attend a divorce hearing by video from abroad?

Possibly, but it is the court’s decision, not your right. Part Six of the Civil Procedure Code lets the judge take any step remotely (Article 331), including outside the emirate, in coordination with the authority where you are (Article 332). Ask the court or your lawyer before the hearing date. If the hearing does go remote, any party can ask at each hearing for it to be held in person, and the court decides after notifying the others (Article 333).

How do I check my divorce case status in Dubai or Abu Dhabi?

In Dubai, log in to the Dubai Courts website or app (individuals sign in with UAE PASS) to see your own files, or use the public inquiry services with your case or application number and year. In Abu Dhabi, the AD Judicial app shows your file, its status and scheduled dates, and the court sends SMS notices to the number you registered. We could not find an official Dubai Courts search that works from an Emirates ID number alone.

Can I file for divorce in Dubai online as a Filipino or Indian expat?

Yes, nationality does not change the online mechanics. At least one spouse must be a citizen or resident of Dubai for Dubai Courts’ online services, your documents must be uploaded as PDFs with legal Arabic translation, and foreign certificates must be legalised in the issuing country and attested in the UAE. What nationality changes is which law applies and whether your home country recognises the UAE judgment, so check that before you file.

Is a WhatsApp or SMS notice from the court valid service?

Yes. Article 9 of the Civil Procedure Code lets the court serve the defendant by recorded audio or video call, text message, smart applications, email, fax or other modern means. Service by email, text message, fax or recorded message takes effect from the date it is sent (Article 11), so a notice you ignore still counts. This is different from a husband sending “talaq” by WhatsApp, which raises separate questions under the 2024 Personal Status Law.

Can I submit the Abu Dhabi civil divorce application online?

Not entirely by yourself. The Abu Dhabi Judicial Department’s Civil Family Court page tells applicants to submit the No-Fault Divorce Application through an Abu Dhabi typing centre. After that the process is largely digital: the court notifies the other spouse by SMS, both parties get the case management session date by SMS, and the court says it aims to finish the case within one month of registration. The application fee is AED 5,000.

How long do I have to pay the court fee after filing online?

Three business days. Under Article 47(1) of the Civil Procedure Code the fee must be paid within three business days starting from the day after the payment notice, otherwise the registration is void and you have to file again. In Dubai the personal status fee is AED 100 per application, capped at AED 2,000, according to the Dubai Courts service page.

Is an electronic divorce judgment valid for use abroad?

An electronic judgment is a valid court document in the UAE: Article 338 gives electronic documents and signatures the same authenticity as paper ones, and Article 131 allows certified copies to be delivered electronically. Foreign authorities usually want more, typically an attested copy and a translation. Since the UAE is not a party to the Apostille Convention, plan for attestation rather than an apostille.
